China R visa: high-level talent and urgently needed specialists

The R visa is for foreign high-level talent and urgently needed specialists, and the conditions are set by the relevant competent authorities of the Chinese government. The two official provisions that say so are quoted below.

The R visa is issued to foreigners of high talent who are needed, or specialists who are urgently needed, by the State (Regulations, Article 6, item (9)). Eligibility depends on conditions and requirements set by the relevant competent authorities of the Chinese government, and the applicant submits the certification materials those authorities call for (Regulations, Article 7, item (9); Visa Application Instructions, R Visa section).

What the R class is

Regulations, Article 6, item (9) reads: "The R visa is issued to foreigners of high talent who are needed, or specialists who are urgently needed, by the State."

The R row of the category table in the Visa Application Instructions reads: "Issued to foreign high-level talents and specialists whose expertise is in urgent need in China."

Who sets the conditions

Regulations, Article 7, item (9) reads: "To apply for the R visa, the applicant shall meet the qualifications and requirements set by the competent authorities of the Chinese government for inviting persons of high talent or urgently needed specialists, and the applicant shall, in accordance with relevant provisions, submit the relevant certification documents;"

The R Visa section of the Visa Application Instructions reads: "The applicant shall meet the introduction conditions and requirements for foreign high-level talents and urgently-needed specialists as determined by the relevant competent authorities of the Chinese government, and submit the corresponding certification materials as required."

Both provisions point to the competent authorities of the Chinese government. The two wordings differ slightly ("set by" in the Regulations, "as determined by" in the Visa Application Instructions), but neither names a particular authority.

Which certificates apply

The R Visa section names no specific certificate. It says the certification materials are submitted "as required", and it names no points test and no salary test.

Regulations, Article 7, item (9) also names no specific certificate. It refers to "the relevant certification documents" submitted "in accordance with relevant provisions".

Two general provisions also apply to every application. Regulations, Article 7 opens with: "A foreigner applying for a visa shall fill out the application form, and submit his or her passport or other international travel documents, qualified photos, and material relating to the purpose of application." The same article ends: "The visa authority may, in light of specific cases, require a foreigner to submit additional application material."

As a planning suggestion, ask the authority that sets the conditions for your category which certificate it expects, because the provisions above do not name one.

Who decides

Section III (Important Tips) of the Visa Application Instructions says: "The consular officials will decide whether to issue a visa and determine its validity, duration of stay and number of entries according to the applicant's specific circumstances."

The same section says: "When necessary, the consular officers may require the applicant to provide other supporting documents or supplementary materials, or require the applicant to attend an interview."

Starting the application

Section I (Basic Documents) of the Visa Application Instructions says that, as required by the Chinese Embassy or Consulate-General in your locality, you fill in the visa application form online and submit the applicant's passport and photo, proof of legal stay or residence, and the previous Chinese passport or previous Chinese visa.

That section refers to the Guidance on Visa Application section of the China Online Visa Application System, or to the website of the Chinese Embassy or Consulate-General in your locality, for specific requirements.

Section III (Important Tips) adds: "For further details, please visit the website of the relevant Chinese Embassy or Consulate-General abroad."
