Extending a residence permit in China: apply within 30 days before it expires

Under Article 32 of China's Exit and Entry Administration Law, a foreigner residing in China applies to extend a residence permit within 30 days before its validity period expires, at the exit/entry administration in the place of residence.

You apply to extend a residence permit within 30 days before its validity period expires. The application goes to the exit/entry administration of the public security organ under the local people's government at or above the county level in your place of residence (Law, Article 32). If the reasons for extension are appropriate and sufficient, an extension is granted; if it is denied, you leave China on the expiry of the validity period in your residence permit (Law, Article 32).

When to apply

Law, Article 32 says foreigners residing in China who apply for an extension shall file "within 30 days prior to the expiry of the validity period on their residence permits."

The English service guide on residence permits, section 3, uses the same window in its own words: the applicant submits the application "30 days before the expiration of the validity period of the residence permit."

A practical suggestion, not a rule: check the expiry date printed on your residence permit now and mark the 30-day window in your calendar.

Where to apply

Law, Article 32 names the place as "the exit/entry administrations of public security organs under local people's governments at or above the county level."

The English service guide, section 3, names the same authority and adds the words "in the place of residence."

What to submit

Regulations, Article 17 lists four items for an application to extend a residence permit. The foreigner shall:

  • fill out an application form;
  • submit his or her passport or other international travel documents;
  • submit qualified photos;
  • submit material relating to the purpose of application.

Law, Article 32 adds that the applicant submits "relevant information of specific application matters in accordance with relevant requirements."

The English service guide, section 3, says the applicant submits "relevant materials for the application as required."

The Chinese text of the National Immigration Administration's service guide for issuing, extending, replacing and reissuing foreigners' residence permits, section 6(3), says that an applicant who extends the residence period or changes the registered items submits the relevant certification materials under the provisions above. The English wording in this paragraph is this site's translation of that Chinese text. The same section says the residence period may be extended and the residence permit may be replaced.

What the decision depends on

Law, Article 32 says that "upon examination, if the reasons for extension are appropriate and sufficient, an extension shall be granted."

The English service guide, section 3, states that "the period of stay shall be extended provided that the reasons for extension are reasonable and sufficient."

Neither text in this section says how long the examination takes.

If the extension is refused

Law, Article 32 says that if an extension is denied, "the foreigner concerned shall leave China on the expiry of the validity period specified in their residence permits."

The English service guide, section 3, says that in case of a denial, "the foreigner shall leave China before the expiry of the residence certificate."

Law, Article 36 says that decisions made by the exit/entry administration of the public security organ "on rejecting applications for visa extension or reissuance, or on not issuing foreigners' stay or residence permits or not extending the duration of residence shall be final."
